According to reports, on March 23rd, Aliyah was enjoying a day at the DoubleTree hotel pool with her family when the unthinkable occurred. Surveillance footage revealed the chilling moment when Aliyah dipped under the water’s surface, never to resurface again. Her frantic mother, Daniela Jaico, immediately reported her daughter missing, setting off a desperate search.

Tim Miller, an expert from the Texas Equusearch rescue team, described the heartbreaking scene captured on video. “You could see her little head go down, and never been seen again, so it was pretty obvious something happened and she never got out of the pool,” he said.

A Tragic Discovery

After an agonizing night of searching, rescue divers made a devastating discovery the following morning. Using poles with attached cameras, they spotted Aliyah’s hand inside a pool pipe. Miller recounted the horrifying details, “How her body was wedged in there, actually shut the pump, shut that suction off. There really wasn’t any suction. Her little body was all the way to the motor, so it took her in a good distance.”

Accusations of Negligence and Cover-Up

The family’s attorney, Richard Nava, revealed that when Daniela Jaico requested to see the surveillance video, the hotel outright refused to provide it. “There was a lot of time wasted. Things at the hotel could have been done a lot better,” Nava stated.

According to the Harris County Medical Examiner’s Office, Aliyah drowned and suffered from “mechanical asphyxiation.” Subsequent inspections by authorities uncovered various violations, leading to the pool’s immediate closure. One investigator noted, “Operator failed to obtain a pre-opening inspection prior to placing the pool into operation after a remodel.”

Miller speculated about the potential cause, suggesting, “It appears right now the pump was put in there, and it was probably malfunctioning because of the open pipe that she ended up in was supposed to be pushing water out.”

Outraged by the tragic loss of their beloved Aliyah, the Jaico family has filed a wrongful death lawsuit against the hotel and its parent companies. They allege gross negligence and are seeking over $1 million in damages.

“We are seeking justice for Aliyah because this could have been avoidable,” Nava asserted. “Everybody knows this could have been avoidable. All the evidence is going to point to this hotel (running) an establishment with many violations. The pool was not in working order.”
