The ongoing defamation lawsuit between Donald Trump and author E. Jean Carroll has taken a combative turn, with the former president’s repeated attacks on the presiding judge potentially putting him at risk of jail time for contempt of court. Trump’s fiery exchanges with Judge Lewis Kaplan and disregard for court orders have raised concerns that the judge may have no choice but to find Trump in contempt if his disruptive behavior continues.

The case stems from rape allegations made by Carroll, who claims Trump sexually assaulted her in a New York City department store dressing room in the 1990s. Trump has vigorously denied the accusations, stating that Carroll fabricated the story. Carroll subsequently sued Trump for defamation after he publicly accused her of lying about the alleged rape.

The trial has been contentious from the start, with Trump lambasting Kaplan as a “Trump hating guy” both inside the courtroom and in social media posts. At one point, Kaplan warned Trump that he could be removed from the courtroom or excluded from the trial if his outbursts persist. “I hope I don’t have to consider excluding you from the trial, I understand you are very eager for me to do that,” Kaplan stated.

Trump’s response of “I would love it, I would love it” did little to ease tensions. His lawyers have also demanded a mistrial over deleted emails from Carroll that they claim are critical evidence. The combative approach plays well with Trump’s political base but legal experts say it risks prejudicing the jury against him and incurring harsh penalties.

“The more he attempts to appease his base, the more he’ll turn off the jury,” explained former lawyer Joe Gallina. He believes Trump’s disruptive conduct could result in Carroll being awarded significantly higher damages than the $5 million she received in a previous defamation suit against Trump earlier this year.

But beyond monetary damages, Trump also faces jail time if held in contempt. Contempt of court involves disrespecting the court’s authority and failing to follow a judge’s orders. It can be punished with fines or even imprisonment. Gallina stated that if Trump keeps ignoring Kaplan’s warnings, the judge may have little recourse but to find Trump in contempt, which could mean jail time.

While Trump may be playing to his political base by portraying himself as the victim of a “witch hunt,” his defiant stance in court could seriously backfire. His legal team contends deleting emails has deprived Trump of critical evidence needed to defend against Carroll’s allegations. But the provocative approach has likely only strengthened the prosecution’s case and jury’s perception of Trump as combative and uncooperative.

Rather than helping his case, Trump’s fiery outbursts and confrontational behavior have given the judge justification for imposing harsh penalties. Though the political points scored may provide short-term gain, the long-term legal consequences could involve substantial monetary damages and even imprisonment if Trump persists in flouting court orders and rules.

Overall, Trump’s refusal to tone down his attacks and abide by standard court decorum demonstrate a disregard for the principles of our legal system. While presidents have broad protections, they are not above the law. Trump’s actions set a dangerous precedent, undermining the legitimacy of the courts by broadcasting to his supporters that judges are partisan and legal proceedings are a sham.

For justice to be properly served in this case, Trump will need to restrain his combative impulses and allow the evidence to speak for itself. The courts cannot function properly if parties ignore basic rules and orders. As such, judges like Kaplan will need to utilize all options, including jail time, to enforce compliance.
